Harper Auto Wash Terms and Conditions

Harper Auto Wash, LLC requires that you agree to the following Terms and Conditions. These Terms and Conditions apply to all Harper Auto Wash products, services, facilities, locations, websites, online checkout forms, kiosks, customer amenities, exterior wash services, interior cleaning services, prepaid products, promotional offers, gift cards, and Unlimited Wash Memberships.
By purchasing, subscribing to, redeeming, entering, using, or receiving any Harper Auto Wash product or service, you agree to these Terms and Conditions.
1. Acceptance of Terms
Use of Harper Auto Wash services constitutes acceptance of these Terms and Conditions. If you do not agree to these Terms and Conditions, do not purchase or use Harper Auto Wash services.
Harper Auto Wash may update these Terms and Conditions from time to time. The version posted or otherwise made available by Harper Auto Wash will govern use of Harper Auto Wash services after the effective date of the updated Terms, except where prohibited by applicable law.
2. Services Covered
These Terms and Conditions apply to, without limitation:
- Single exterior wash purchases
- Unlimited Wash Memberships
- Interior cleaning services, including Finish Lane services
- Customer amenities and self-service areas
- Gift cards, prepaid wash purchases, wash books, promotional vouchers, QR-code offers, and similar prepaid or promotional products
- Online, kiosk, point-of-sale, mobile, or in-person transactions
- Any other services, products, benefits, features, or facilities provided by Harper Auto Wash
3. Unlimited Membership Program
Your Harper Auto Wash Unlimited Wash Membership automatically renews each month on or about the anniversary date of the initial sign-up date. The membership fee, plus any applicable taxes or fees, will be charged to your billing card each month on the renewal date unless and until the membership is canceled according to the cancellation procedures described in these Terms.
Unlimited Memberships are intended for reasonable personal use by the registered vehicle only. Harper Auto Wash reserves the right to limit, suspend, or terminate use that Harper Auto Wash determines to be excessive, abusive, fraudulent, unsafe, disruptive, commercial in nature, or inconsistent with ordinary personal vehicle care.
Membership benefits are valid only while the membership is active, paid, and in good standing. Membership benefits have no cash value and may not be transferred, sold, shared, assigned, bartered, or exchanged.
4. Automatic Renewal Charge Authorization
By subscribing to a Harper Auto Wash Unlimited Wash Membership, you authorize Harper Auto Wash to charge your payment method on a recurring monthly basis until you cancel your membership according to the program procedures.
You agree to pay all applicable membership fees, taxes, and charges associated with your membership. Recurring charges will generally occur on or about the same date each month. If a billing date falls on a date that does not occur in a given month, or if processing is delayed due to payment processor, bank, system, or operational timing, the charge may occur on a nearby date.
You understand that membership pricing, benefits, services, or program terms may change from time to time, subject to applicable law. Harper Auto Wash, LLC or its payment processor will appear as the billing party or merchant on your payment statement.
Before completing an online Unlimited Wash Membership purchase, you may be asked to provide affirmative consent to recurring monthly billing, the selected plan price, the automatic renewal terms, and the cancellation process. Harper Auto Wash may retain records of your consent, including the plan selected, price, date, time, customer information, vehicle information, transaction information, and version of the Terms accepted.
5. Cancellation Policy
You may cancel your Unlimited Wash Membership online through the membership management portal or other approved online cancellation method made available by Harper Auto Wash. Harper Auto Wash team members may assist customers in accessing the cancellation process; however, cancellation is not complete until submitted through an approved cancellation method.
Unless otherwise required by applicable law, cancellation stops future renewal charges but does not provide a credit, prorated refund, partial-month refund, or refund for the current billing period. If you cancel your membership, it will remain valid until the end of the current paid monthly billing period.
For example, if a membership is purchased on May 15 and canceled on June 30, the membership remains active until July 15, and no prorated refund or partial-month credit will be provided.
6. Failed Payments, Account Suspension, and Chargebacks
If Harper Auto Wash is unable to receive payment due to expiration, insufficient funds, declined transactions, chargeback, reversed payment, inaccurate payment information, processor error, or any other payment failure, your membership may be halted immediately and wash privileges may be suspended.
Harper Auto Wash may attempt to reprocess declined payments during the fourteen (14) day period following the halted date. Harper Auto Wash may receive updated payment card information from payment networks, card issuers, or payment processors and may use such updated payment information to continue billing the membership unless the member cancels.
If payment is successfully collected within fourteen (14) days of the halted date, your membership may continue without requiring a new enrollment. If payment is not successfully collected within fourteen (14) days, your membership will automatically deactivate and may only be reactivated at then-current retail pricing.
If a customer disputes a valid charge, initiates a chargeback, reverses payment after receiving services, or otherwise fails to pay amounts due, Harper Auto Wash may suspend or terminate the membership, deny future service, recover unpaid amounts, and require a valid payment method before reinstatement.
7. Membership Vehicle Rules and Transfers
Membership is valid only for the vehicle registered with Harper Auto Wash. Unauthorized transfer of a membership sticker, RFID tag, license plate recognition profile, account, barcode, QR code, or membership benefit to another vehicle may result in immediate termination of the membership without refund.
Membership transfers are permitted only upon replacement or acquisition of a new vehicle and after notifying Harper Auto Wash through an approved process.
8. Pricing, Program Changes, Promotions, Upgrades, and Downgrades
Harper Auto Wash reserves the right to cancel, modify, amend, suspend, or discontinue any membership program, pricing, package, promotion, discount, benefit, feature, product, location, service, amenity, or operating practice at any time, subject to applicable law.
Membership pricing may be adjusted from time to time. Continued participation in the membership program after any pricing adjustment becomes effective constitutes acceptance of the updated pricing, except where prohibited by applicable law.
Promotional pricing, discounted memberships, trial offers, limited-time offers, coupons, QR-code offers, special campaigns, and similar offers are subject to the specific terms presented at the time of purchase or redemption. Unless otherwise stated, promotional pricing applies only for the stated promotional period, after which the membership renews at the then-current standard retail price for the selected plan.
Promotions may not be combined, transferred, redeemed for cash, applied retroactively, extended beyond the stated promotional period, or used in a manner inconsistent with the offer terms unless expressly authorized by Harper Auto Wash.
Upgrades may take effect immediately and may result in an immediate prorated or full charge. Downgrades generally take effect at the next billing cycle unless otherwise authorized by Harper Auto Wash.
9. Equipment Availability, Weather, and Service Interruptions
Although Unlimited Wash Memberships provide unlimited-use benefits for eligible vehicles, Harper Auto Wash equipment is mechanical and may occasionally be unavailable due to maintenance, repairs, weather conditions, utility interruptions, equipment malfunctions, staffing conditions, safety concerns, site closures, utility failures, payment processor issues, system outages, or circumstances beyond Harper Auto Wash's control.
Temporary interruptions, closures, reduced hours, service delays, unavailable amenities, unavailable interior services, or unavailable equipment shall not entitle members or customers to refunds, credits, extensions, prorated adjustments, or other compensation.
10. Vehicle Eligibility and Customer Responsibilities
Membership is not valid for vehicles that cannot safely fit on the conveyor system, cannot be safely loaded, cannot be safely processed through the wash tunnel, or otherwise fail to meet equipment, clearance, safety, or operational requirements.
Customers are responsible for following all posted signs, warnings, verbal instructions, hand signals, and team member directions. Customers must ensure their vehicle is safe and ready before entering the wash tunnel or service area.
Before entering the wash tunnel, customers are responsible for placing the vehicle in neutral when directed, releasing the brake when directed, turning off automatic wipers, disabling automatic braking or auto-hold features where applicable, folding mirrors if instructed, closing all windows and sunroofs, closing doors and fuel doors, securing loose items, emptying truck beds, removing or securing exterior accessories when instructed, and otherwise preparing the vehicle for safe washing.
Harper Auto Wash is not responsible for damage, injury, loss, collision, derailment, or incident caused by failure to follow instructions, vehicle movement, braking, steering, exiting the conveyor, driver-assistance features, automatic wipers, automatic braking, auto-hold systems, unsecured cargo, open windows, open doors, open sunroofs, open fuel doors, trailer hitches, loose accessories, or similar customer-controlled conditions.
Harper Auto Wash may refuse or discontinue service for vehicles that present safety, equipment, clearance, operational, sanitation, or damage-risk concerns. This may include, without limitation, vehicles with trailers, open beds containing items or debris, loose parts, leaking fluids, excessive mud, hazardous materials, unsupported modifications, excessive width, excessive height, excessive length, insufficient clearance, or other conditions that Harper Auto Wash determines may be unsafe or unsuitable.
11. Exterior Wash Results and No Cleaning Guarantee
Harper Auto Wash strives to provide excellent service and consistent wash quality. However, cleaning results vary based on vehicle condition, surface condition, age, maintenance history, environmental exposure, materials, weather, service selected, and substances on or in the vehicle.
Harper Auto Wash does not guarantee removal of all dirt, bugs, tar, sap, road paint, brake dust, oxidation, water spots, mildew, stains, odors, sand, mud, grease, adhesive, overspray, or other substances. Harper Auto Wash is not responsible for unsatisfactory cleaning results where no equipment malfunction or verified service failure occurred.
At its sole discretion, Harper Auto Wash may provide a courtesy rewash in lieu of any refund, credit, or adjustment. A courtesy rewash does not constitute an admission of fault, liability, or responsibility.
12. Interior Cleaning and Finish Lane Services
Interior cleaning services, including Finish Lane services, are limited-service cleaning services. They are not full detailing, restoration, stain removal, odor removal, biohazard remediation, reconditioning, repair, or specialty cleaning services.
Results may vary based on vehicle condition, age, materials, stains, sand, mud, spills, odors, prior cleaning products, wear, interior layout, upholstery type, and customer belongings or obstructions.
Customers are responsible for removing valuables, personal items, restricted or dangerous items, medications, money, electronics, documents, fragile items, child seats, loose belongings, and any items they do not want handled, moved, vacuumed around, or discarded before service. Harper Auto Wash is not responsible for loss of or damage to personal property left in the vehicle, including items in consoles, cupholders, seat pockets, door pockets, trunks, cargo areas, under seats, or any other storage area.
Harper Auto Wash team members will not open locked compartments, glove boxes, bags, purses, luggage.
Harper Auto Wash may refuse, pause, or discontinue interior service for vehicles containing excessive trash, bodily fluids, mold, infestations, hazardous materials, unlawful items, unsafe items, broken glass, biohazards, or conditions that present a safety, sanitation, legal, or operational concern.
Screens, touchscreens, controls, buttons, vents, leather, suede, alcantara, wood trim, piano-black trim, chrome trim, aftermarket accessories, tint, wraps, delicate surfaces, worn materials, previously repaired surfaces, loose parts, and damaged interior components are cleaned at the customer's risk unless damage is directly caused by verified Harper Auto Wash negligence or a verified malfunction of Harper Auto Wash equipment.
13. Customer Amenities
Customer amenities are provided as a convenience for customers who have purchased a wash service from Harper Auto Wash and are intended solely for use by paying customers.
Amenities may include, but are not limited to:
- Vacuum stations
- Mat cleaning machines
- Towels
- Compressed air stations
- All-surface cleaner spray
- Any other self-service amenities provided by Harper Auto Wash
All amenities are used at the customer's sole discretion and risk. Customers are responsible for ensuring the proper and safe use of all amenities, equipment, chemicals, and cleaning products. Customers should follow all posted instructions and warnings when utilizing any amenity.
Harper Auto Wash is not responsible for any damage, injury, loss, or claim arising from the use or misuse of customer amenities, including but not limited to damage resulting from vacuum use, compressed air use, cleaning chemicals, towels, brushes, mat cleaning equipment, or any other self-service equipment or products provided on-site.
Harper Auto Wash reserves the right to limit, modify, suspend, or remove customer amenities at any time without notice. Use of customer amenities constitutes acceptance of these Terms and Conditions.
14. Gift Cards, Prepaid Purchases, and Refund Policy
All gift card sales are final. Gift cards are non-refundable, non-redeemable for cash except where required by law, and may not be applied toward the purchase, renewal, upgrade, downgrade, or payment of any Unlimited Wash Membership unless expressly authorized by Harper Auto Wash.
Gift cards do not expire except as permitted by applicable law. Harper Auto Wash does not charge dormancy, inactivity, service, or administrative fees on gift cards except where permitted by applicable law.
Harper Auto Wash is not responsible for lost, stolen, damaged, altered, or unauthorized use of gift cards.
All prepaid wash purchases, wash packages, wash books, promotional wash vouchers, and similar prepaid products are final and non-refundable. All single wash purchases are final and non-refundable once purchased, whether purchased in person, online, through a kiosk, mobile device, promotional offer, QR code, or any other sales channel.
No refunds, credits, exchanges, or adjustments will be provided for:
- Customer dissatisfaction where no equipment malfunction or verified service failure occurred
- Failure to use a purchased wash, prepaid product, promotion, or voucher
- Weather conditions before or after a wash
- Vehicle conditions that limit cleaning performance
- Customer error in selecting a wash package
- Partially used memberships
- Unused services or benefits
- Temporary service interruptions, unavailable amenities, unavailable interior services, or site closures
Harper Auto Wash reserves the right, at its sole discretion, to provide a courtesy rewash in lieu of any refund. Except where prohibited by applicable law, all sales are final.
15. Right to Refuse Service and Site Conduct
Harper Auto Wash reserves the right to refuse service to any customer or vehicle for safety, operational, legal, equipment, conduct-related, or business reasons.
This includes, but is not limited to:
- Unsafe vehicle conditions
- Excessively damaged vehicles
- Vehicles with unsecured accessories or cargo
- Vehicles that do not meet equipment or clearance requirements
- Abusive, threatening, harassing, disruptive, intoxicated, unsafe, or unlawful customer behavior
- Suspected fraud, theft, misuse, chargeback abuse, or unauthorized use of Harper Auto Wash services
- Failure to follow posted signs, safety instructions, or team member directions
Harper Auto Wash does not refuse service on the basis of race, color, religion, sex, national origin, disability, age, veteran status, or any other protected status. Service may be refused, modified, suspended, or discontinued for legitimate safety, operational, legal, equipment, or conduct-related reasons.
Customers are responsible for supervising children and guests while on Harper Auto Wash property. Customers and guests must remain in designated customer areas and may not enter restricted areas, wash tunnels, equipment rooms, Finish Lane work areas, employee-only areas, vehicle travel lanes, or other operational areas unless directed by Harper Auto Wash personnel.
16. Damage and Liability Limitation
At Harper Auto Wash, we take pride in delivering excellent customer service and vehicle care. Please review the following damage claim policy carefully before submitting a claim.
16.1 Claims Process
Damage claims must be reported before leaving the premises whenever reasonably possible, and no later than twenty-four (24) hours after the wash or service. Claims reported after that time may be denied due to the inability to verify condition, timing, and causation.
Customers must provide the date, time, location, wash type, vehicle information, photographs, and a description of the alleged damage. Harper Auto Wash may review video, photographs, tunnel logs, equipment records, inspection records, loading footage, prep activity, Finish Lane activity, team member statements, customer statements, transaction records, and other available documentation.
Upon submission of a damage claim, management will contact the customer via email, phone, or a combination of both after investigating the incident. Please allow a minimum of forty-eight (48) hours or two (2) business days for review of relevant videos, photographs, inspection records, and other documentation.
Submission of a claim does not constitute an admission of liability, fault, negligence, or responsibility by Harper Auto Wash.
16.2 Responsibility
Harper Auto Wash operates on an enter-at-your-own-risk basis.
Harper Auto Wash is responsible only for damage directly caused by a verified malfunction of Harper Auto Wash equipment, verified negligence by Harper Auto Wash, or a verified direct act or omission by Harper Auto Wash while the vehicle is actively being processed or serviced by Harper Auto Wash.
Harper Auto Wash is not responsible for damage, loss, or claims that:
- Existed before entering the wash facility
- Result from pre-existing vehicle conditions or defects
- Involve loose, damaged, worn, improperly installed, deteriorated, previously repaired, repainted, oxidized, rusted, cracked, or defective components
- Arise from customer negligence or failure to follow instructions
- Are caused directly or indirectly by another customer
- Are caused by acts of nature, weather events, flying debris, road debris, utility interruptions, power failures, or circumstances beyond Harper Auto Wash's reasonable control
- Result from vehicle movement, braking, steering, driver-assistance features, automatic wipers, automatic braking, auto-hold systems, open windows, open sunroofs, open doors, open fuel doors, unsecured cargo, or other customer-controlled conditions
- Involve personal property left inside, attached to, or on top of the vehicle
16.3 Higher-Risk Conditions and Components
The following conditions and components are considered higher risk in automated washing or interior cleaning and may limit or exclude Harper Auto Wash's responsibility unless damage is directly caused by a verified equipment malfunction, verified Harper Auto Wash negligence, or a verified direct act or omission by Harper Auto Wash:
- Aftermarket accessories or parts
- Wheels, tires, low-profile tires, aftermarket wheels, wheel finishes, center caps, valve stem caps, and pre-existing curb rash or corrosion
- Light bars
- Bug guards
- Window visors
- Aftermarket antennas
- Roof racks
- Bike racks
- Cargo carriers
- Ladders or ladder racks
- Vanity license plates or license plate frames
- Running boards
- Tow mirrors
- Trailer hitches or towing accessories
- Lifted, lowered, oversized, modified, or specialty vehicles
- Vehicles with less than four (4) inches of ground clearance
- Vehicles more than seven (7) years old or vehicles with aged, worn, deteriorated, oxidized, rusted, or previously repaired components
- Loose trim, moldings, emblems, decals, wraps, paint protection film, body components, spoilers, louvers, clips, seals, or weatherstripping
- Repainted surfaces, body filler, prior collision repairs, peeling clearcoat, cracked paint, oxidized paint, rust, corrosion, or manufacturer defects
- Cracked, chipped, weakened, aftermarket, or previously repaired glass
- Items blown from the vehicle during washing or drying
- Screens, touchscreens, controls, vents, delicate interior surfaces, worn interior materials, previously repaired interior surfaces, loose interior parts, or damaged interior components
16.4 Decision Authority and Repair Process
The Director of Operations or designated management representative retains authority to approve or deny damage claims through Harper Auto Wash’s internal claim review process based upon these Terms, available evidence, operational records, and the results of Harper Auto Wash’s investigation. Nothing in this section is intended to limit any rights a customer may have under applicable law.
If a claim is approved, Harper Auto Wash may, at its discretion, offer one or more commercially reasonable resolutions, including a courtesy rewash, reimbursement, direct payment to a repair provider, repair through a provider selected or approved by Harper Auto Wash, or another reasonable resolution based on the nature and extent of the verified damage.
Harper Auto Wash may require repair estimates, photographs, inspection, documentation, and written approval of repair scope before authorizing payment or reimbursement. Harper Auto Wash may also pay an approved repair provider directly.
If Harper Auto Wash offers repair through a provider selected or approved by Harper Auto Wash, the provider will be a commercially reasonable repair provider for the approved repair scope. If the customer elects to use a different repair provider, Harper Auto Wash may limit any payment or reimbursement to the reasonable and approved cost of repairing the verified damage, unless otherwise required by applicable law.
Approval of a claim, payment toward a repair, or offer of a courtesy resolution does not constitute an admission of fault, negligence, or liability beyond the specific resolution approved in writing by Harper Auto Wash.
17. Limitation of Liability
To the fullest extent permitted by law, Harper Auto Wash's total liability for any claim arising out of or related to the use of its services shall be limited to the actual cost of the wash service purchased by the customer or the direct repair cost of verified damage caused solely by Harper Auto Wash equipment, verified Harper Auto Wash negligence, or a verified direct act or omission by Harper Auto Wash, whichever is applicable.
Harper Auto Wash shall not be liable for indirect, incidental, consequential, punitive, special, exemplary, loss-of-use, lost-profit, diminution-of-value, rental-car, transportation, inconvenience, emotional distress, or similar damages, except where prohibited by applicable law.
18. Privacy, Cameras, RFID, License Plate Recognition, and Communications
Harper Auto Wash may collect and use customer, vehicle, transaction, membership, RFID, license plate, image, video, audio, site-usage, communication, and service information to operate the business, verify memberships, process payments, prevent fraud, investigate incidents, improve service, communicate with customers, administer promotions, and maintain safety and security.
Harper Auto Wash locations may use video surveillance, license plate recognition, RFID systems, point-of-sale records, customer communication systems, online checkout systems, and other operational technologies. By using Harper Auto Wash services, customers acknowledge that such systems may be used on-site or in connection with Harper Auto Wash services.
Customer information may be processed by Harper Auto Wash and its service providers, including payment processors, point-of-sale providers, customer communication platforms, customer relationship management systems, analytics providers, security vendors, and other technology vendors. Harper Auto Wash does not sell customer payment card information.
Harper Auto Wash may send transactional messages related to accounts, billing, cancellations, service issues, membership status, customer service, damage claims, or operational matters. Promotional text messages, emails, or similar marketing communications may be subject to separate consent requirements. Consent to receive promotional communications is not required to purchase goods or services. Customers may opt out of promotional text messages by replying STOP where applicable.
19. Force Majeure
Harper Auto Wash shall not be liable for delays, interruptions, closures, reduced hours, unavailable services, unavailable amenities, or inability to provide services resulting from events beyond its reasonable control, including but not limited to weather events, floods, storms, lightning, power outages, utility failures, internet outages, payment processor failures, labor disputes, governmental actions, equipment failures, acts of God, emergencies, safety conditions, supply interruptions, or other unforeseen circumstances.
20. Changes to Terms
Harper Auto Wash may amend, update, or replace these Terms and Conditions from time to time. Updated Terms may be posted online, provided at the time of purchase, included in customer communications, or otherwise made available by Harper Auto Wash. Continued purchase or use of Harper Auto Wash services after updated Terms become effective constitutes acceptance of the updated Terms, except where prohibited by applicable law.
21. Governing Law and Venue
These Terms and Conditions shall be governed by and construed under the laws of the State of Tennessee, without regard to conflict-of-law rules. Any legal action arising from or relating to these Terms and Conditions or the use of Harper Auto Wash services shall be brought exclusively in the state or federal courts located in Tennessee, except where prohibited by applicable law.
Before initiating legal action, customers agree to provide Harper Auto Wash written notice of the claim and a reasonable opportunity to investigate and resolve the matter.
